Terms of Service.

This is the agreement between you and Hey Gaargi when you use our app, website, or any related service.

01Acceptance of terms

By creating an account, downloading our mobile application, or otherwise using the Hey Gaargi service (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Cookie Policy, our Refund & Cancellation Policy, our Astrology Disclaimer, and our Grievance Redressal mechanism. Together, these documents form a legally binding contract between you ("you", "User") and HEY GAARGI ("Hey Gaargi", "we", "us", "our"), a sole proprietorship business owned and operated by Kamarajugadda Sai Raghava, with its principal place of business at Tenali, Andhra Pradesh, India.

If you do not agree with any part of these Terms, please do not use the Service.

02Who can use Hey Gaargi

You may use the Service only if you are at least 18 years of age and competent to enter into a contract under Section 11 of the Indian Contract Act, 1872. If you are between 13 and 18, you may use the Service only with the verifiable consent of a parent or legal guardian, and your account is subject to additional restrictions under the Digital Personal Data Protection Act 2023. Users under 13 are not permitted to use the Service.

You also represent that you are not a person barred from receiving services under the laws of India or any other applicable jurisdiction.

03Your account

To use most features, you must create an account using a valid email address and/or Indian mobile number. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us at help@heygaargi.com immediately if you suspect unauthorised access.

You must provide accurate birth details (date, time, place) for astrological computations. Hey Gaargi does not verify the accuracy of these inputs and is not responsible for readings that are incorrect because of inaccurate inputs you provided.

04The service

Hey Gaargi offers an AI-assisted Vedic astrology chat experience. The Service includes (but is not limited to): birth chart and divisional chart computation; daśā and transit analysis; compatibility readings (porutham/guṇa milāp); educational content; and, on paid plans, personal AI-generated consultations on your own chart.

We may add, modify, or remove features at any time. Material removals from a paid plan will be communicated at least 30 days in advance, and you will have the option to cancel without penalty under our Refund Policy.

05Payments and billing

Hey Gaargi has one paid plan: Ask Gaargi, starting at ₹30 for one consultation, purchased one-time with no recurring charges. Once signed in, a +/− counter adds more consultations in the same ₹30-per-consultation increments. Detailed pricing, taxes, billing partners, and refund mechanics are set out in our Pricing and Refund & Cancellation Policy. Both documents form part of these Terms.

All prices for Indian users are inclusive of GST at applicable rates. Tax invoices are issued in compliance with Rule 46 of the CGST Rules 2017.

06User conduct

When using the Service, you agree not to:

• Violate any law, regulation, or third-party right, including the Information Technology Act 2000 and the rules made thereunder;
• Upload, share, or generate any content that is unlawful, defamatory, obscene, paedophilic, invasive of another's privacy (including bodily privacy), insulting on the basis of gender, religion, race, or caste, encouraging money-laundering or gambling, or that is harmful to children — as enumerated under Rule 3(1)(b) of the IT (Intermediary Guidelines & Digital Media Ethics Code) Rules, 2021;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Use the Service to provide medical, legal, financial, or psychiatric advice to third parties;
• Reverse-engineer, decompile, scrape, or attempt to extract the underlying models, prompts, or training data of the Service;
• Resell, sub-license, or commercially redistribute the Service or any output, except as expressly permitted in writing;
• Use automated means (bots, crawlers) to access the Service except through documented public APIs;
• Interfere with the security or integrity of the Service, including by transmitting viruses, denial-of-service attacks, or unauthorised access attempts.

Violation may result in suspension or termination of your account, and we may report serious violations to law enforcement.

07User content

You retain ownership of the birth details, questions, photographs, and other content you submit to the Service ("User Content"). You grant Hey Gaargi a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process your User Content solely for the purpose of providing and improving the Service. We do not sell User Content. We do not use the contents of your private conversations to train third-party AI models without your explicit opt-in.

You represent that you have all necessary rights to the User Content you submit, and that it does not infringe any third party's rights or violate any law.

08Intellectual property

The Service, including its software, user interface, brand name "Hey Gaargi", the Gaargi mark, logos, and all related content (excluding User Content) is owned by HEY GAARGI and protected by Indian and international copyright, trademark, and other intellectual-property laws. Nothing in these Terms grants you any right or licence in our intellectual property except as expressly stated.

09Astrology — important limits

You acknowledge that astrology is not a science recognised by the scientific establishment, and that readings on Hey Gaargi are offered for educational, cultural, and entertainment purposes. Readings must not be used as a substitute for professional advice in medicine, mental health, law, finance, employment, marriage, or any other domain where qualified human judgement is required. 10Privacy

Your privacy is governed by our Privacy Policy, which describes what data we collect, how we use it, your rights as a Data Principal under the Digital Personal Data Protection Act 2023, and our retention practices.

11Disclaimers and warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. Astrological predictions are interpretive — they are not guarantees of outcomes. We do not warrant that the Service will meet your specific requirements or that it will be error-free.

12Limitation of liability

To the maximum extent permitted by Indian law, Hey Gaargi, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Service.

Our aggregate liability to you for all claims in any 12-month period shall not exceed the greater of (a) the amount you paid us for the Service in the preceding 12 months, or (b) ₹5,000 (Rupees Five Thousand).

Nothing in these Terms limits any liability that cannot be limited under Indian law, including liability for fraud or wilful misconduct.

13Indemnity

You agree to indemnify and hold harmless Hey Gaargi and its affiliates from any claims, damages, costs, and expenses (including reasonable legal fees) arising out of (a) your violation of these Terms, (b) your User Content, or (c) your violation of any law or third-party right.

14Suspension and termination

You may terminate your account at any time via Settings → Account → Delete account. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you poses a security or legal risk. We will use reasonable efforts to notify you before termination unless doing so would prejudice an investigation or violate law.

Sections that by their nature should survive termination (intellectual property, limitation of liability, indemnity, governing law) shall survive.

15Grievance redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to address user complaints. Full details, including the Officer's contact information and resolution timelines, are at Grievance Redressal.

16Governing law and disputes

These Terms are governed by the laws of the Republic of India. Subject to the grievance-redressal process above, any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to arbitration in accordance with the Arbitration and Conciliation Act 1996, by a sole arbitrator appointed by Hey Gaargi. The seat and venue of arbitration shall be Tenali, Andhra Pradesh, and proceedings shall be conducted in English. Courts at Tenali, Andhra Pradesh shall have exclusive jurisdiction in respect of any non-arbitrable matters.

17Changes to these terms

We may revise these Terms from time to time. Material changes will be notified by email and via an in-app notice at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
